Terms of Use

1. Acceptance

These Terms of Use form a legal agreement between you and the operators of MemoVana regarding your use of the memovana.com website, the MemoVana iOS app, the DreamerVana iOS app, and related software, features, content, and services (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms of Use.

If you do not agree to these terms, do not use the Services. If you use the Services on behalf of a business or organization, you represent that you have authority to bind that entity to these terms.

2. Access & Continuity

MemoVana and DreamerVana are iOS apps designed to work local-first. Neither app requires creating a MemoVana account or password on our servers. You can use core features on your device without signing up with us.

Optional Premium Continuity (when offered) uses private iCloud under your Apple ID (CloudKit). Continuity is not auto-enabled merely because you subscribe. You remain responsible for securing your device, Apple ID, and any Face ID / passcode protections you enable (for example DreamerVana Vault).

If you contact us for support or use website forms, you are responsible for providing accurate contact information for that correspondence.

3. License

Subject to these terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal or internal business use in accordance with the functionality made available to you (including free and Premium features as applicable).

This license does not transfer any ownership rights in MemoVana, DreamerVana, the website, branding, software, service content, or underlying technology.

4. Subscriptions

MemoVana and DreamerVana may each offer optional Premium subscriptions or other paid features. Pricing, billing intervals, feature access, renewal terms, and any trial conditions are presented at the time of purchase in the App Store.

Purchases are processed by Apple through StoreKit / the App Store. Payment, billing, renewal, and cancellation are handled under Apple’s terms and your Apple ID subscription settings. Manage or cancel subscriptions in iOS Settings → Apple ID → Subscriptions (or the equivalent App Store controls). Except where required by law, fees are non-refundable once charged; refund requests are generally handled by Apple under its policies.

Website content does not itself bill you; paid access lives in the apps unless we clearly state otherwise at purchase.

5. User content

You retain ownership of the content you create or submit through the Services, including:

• MemoVana: voice recordings, transcripts, notes, action items, folders, vocabulary, and related memo material.
• DreamerVana: dream journal entries, interpretations, symbols, personal meanings, Vault-locked entries, and related journal material.

Because the apps are local-first, your content generally stays on your device unless you opt into Continuity, export/share it, or send it through support or other channels you choose. Where we process content you send us (for example support attachments) or where platform features you enable require processing, you grant a limited license only as reasonably necessary to operate those features for you — not to sell your personal journal or memo content.

You are responsible for ensuring you have the rights and permissions needed to record, upload, or process any content you use with the Services.

6. AI features

The Services may provide AI-assisted features for convenience. These outputs may be incomplete or inaccurate. You are responsible for reviewing them before relying on them.

MemoVana

Features may include transcription, summaries, organization, search, Ask, action-item suggestions, and related enrichment (including on-device Apple Intelligence / Foundation Models when available on your device).

DreamerVana

Features may include dream interpretation aids, symbol suggestions, pattern views, Ask, and related reflective journaling tools. These are for personal reflection and journaling — not medical, psychological, diagnostic, or treatment advice, and not a substitute for care from a qualified professional.

Do not rely on AI outputs for legal, medical, financial, compliance, employment, or other important decisions without independent review.

7. Privacy

Your use of the Services is also described in our Privacy Policy (https://memovana.com/privacy). Review that policy for how information may be collected, used, and handled — including local-first storage, optional Continuity, and optional HealthKit sleep context in DreamerVana.

You are responsible for deciding what information you choose to store in the apps or share through the website and support channels.

8. Acceptable use

You agree not to misuse the Services or help anyone else do so. You may not use the Services in violation of law, to infringe the rights of others, to interfere with system integrity, or to attempt unauthorized access to any account, network, or service component.

• Do not upload or store unlawful, harmful, fraudulent, or infringing content.
• Do not interfere with security features, platform operations, or other users.
• Do not reverse engineer, scrape, or exploit the Services beyond permitted use (except where such restriction is prohibited by law).
• Do not misrepresent DreamerVana outputs as medical or clinical advice.

9. Intellectual property

MemoVana, DreamerVana, and related software, designs, branding, text, interfaces, and service materials (other than your user content) are owned by us or our licensors and are protected by applicable intellectual property laws.

Except for the limited license granted above, no rights are granted to you by implication or otherwise.

10. Termination

We may suspend or terminate access to website features or withhold support if these terms are violated, if use creates risk or harm, or if required for operational, security, or legal reasons. App Store distribution and device access remain subject to Apple’s rules and your device controls.

You may stop using the Services at any time, including by deleting the apps or uninstalling them. Provisions that should reasonably survive termination will continue to apply after termination.

11. Disclaimers

The Services are provided on an “as is” and “as available” basis to the fullest extent permitted by law. We disclaim warranties of any kind, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee uninterrupted availability, complete accuracy, or error-free operation of transcripts, summaries, interpretations, patterns, or other outputs.

DreamerVana is a reflective dream journal. It is not a medical device and does not diagnose, treat, cure, or prevent any condition. Optional Apple Health / HealthKit sleep data (when you enable it) is for chart context only — not sleep coaching, therapy, or clinical guidance.

12. Liability

To the fullest extent permitted by law, we and our affiliates, licensors, contractors, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenues, data, or goodwill arising out of or related to your use of the Services.

To the fullest extent permitted by law, any liability arising from the Services or these terms will be limited to the amount you paid, if any, for the relevant paid feature giving rise to the claim during the twelve (12) months before the claim.

13. Changes

We may update these Terms of Use from time to time. The Last Updated date at the top will change when we do. Continued use of MemoVana, DreamerVana, or this website after updated terms take effect constitutes acceptance of the revised terms.

We may also modify, suspend, or discontinue some or all of the Services at any time.
